Breach of contract complaint review


if you have Waste Management of Pennsylvania hauling your commercial trash they have breached their contract with you multiple times. Their "annual" price increases are more frequent than annual and go way above what their terms indicate as CPI or CPI +4. In fact its 9% or more. Also they calculate their fuel surcharges on top of all other surcharges which inflates the price even more. They charge a "recycling maintennance offset fee" which was supposed to make up for a low commodity market which has since recovered but gues what- the charge is still their, yet another breach of contract. They are 25-40% higher than other haulers. Best thing you can do is get pricing from another hauler, stop paying the WM bill. They will make collections calls and threaten you with "liquidated damages" but in the end they will just remove the can..they are losing $250,000 a month due to their pricing. They care only about meeting Wall St. goals and getting management bonus by charging their Customers as much as possible and hoping you pay their inflated bills.

My problem is that I signed a contract in 2001 for a 4 cu. yd. dumpster twice a month for $31.19. My bill is now $92.00 with the last increase $12.00 in one month. My contract expires this year and so I sent a certified letter and they sent back a document I had signed in 2009 which when it was sent to me explained that this was necessary to continue service. They tell me this document is my new contract with different dates and will not cancel even though I have sent them copies of my original contract and service agreement. This is all for the same account. This is underhanded. I will write a letter to the Ohio Attorney General and also to the better Business Bureau. This like the credit card companies who change the due date hoping you will make a late payment.

The problem I have is that I signed a contract in 2001 for a 4 cu. yd dumpster every other week and it has gone from $31.19 to $92.00 per month with the last increase being $12.00 in one month. The contract was supposed to end in July so I mailed a cancellation notice and they sent me a letter I had signed in 2009 which they said (at that time)I needed to sign to continue service but now they say that was a new contract and my old one is void. This is underhanded. I will write a letter to The Ohio Attorney General and the Better Business Bureau and hope that they will stick to the original contract. This is like credit card companies who change the due date trying to get you to make a late payment.

i was in sales there and was fired because i had to lie to people like you. Your contract specifically states any raise in the base rate due to annual price increases is ANNUAL if it was changed before your price increase anniversary then they broke the contract....also if your increase was more than the consumer price index or the consumer price index plus 4 (depending on whats in the terms) then they again broke contract..you would have to look up the CPI at the time of last increase--this is specific to the base rate...i'm assuming your a commercial customer and not residential. also be aware that fuel surcharges are calculated on top of your overall invoice inflating it even moreso..also if you pay for recyling and have been given the recycling offset fee and it was not specified in the contract that one is breach of contract as well...if you check your invoices i'm sure you will find either a)an increase to the base rate prior to your "annual price increase" date or an increase that does not match the Consumer Price Index as in terms of the contract....they are greedy corporate pigs and you can see in the CEO's quarterly reports to Wall St that they intend on getting as much in the way of PI's as possible even at the loss of some Customers...to them it's all about Wall St and on the local level the Managers are only concerned about getting their bonus att he expense of Customers and employees...i'm sure you will find a local hauler who does a fine job at a fair rate..take care...

I have had the same problem with my bill going up every month. It origialy was contracted for $60.00 a month and now they are sending bills for $92.00 a month. They have fuel chages and admin. chages. Waiting for them to charge me for the drivers lunch. I have refused to pay more then what is resonable I have been working with the sales person , but still am not satisfied. Waste management to me are dishonest and in the future will not be doing bussness with them( after my contrct is over). What info do you have that they have voided the contrect by over charging?
